Tradenalyze Terms of Service

01. Agreement to these Terms

These Terms of Service ("Terms") form a binding agreement between you ("you," "your") and the Tradenalyze team ("Tradenalyze," "we," "us," or "our") governing your access to and use of the Tradenalyze iOS app and any associated website (together, the "Service").

By creating an account or otherwise using the Service, you confirm you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

02. The Service

Tradenalyze uses artificial intelligence to help you analyze trading charts and build a consistent journaling and review practice. The Service provides AI-generated technical analysis, pattern recognition, key level identification, and trade planning tools based on chart images you upload.

The Service is informational only. It is not investment advice, financial advice, trading advice, or any other sort of advice. We are not a broker, financial institution, or investment adviser.

03. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm you have parental or guardian consent. By using the Service, you represent that you meet these requirements.

04. Account

• You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
• You must provide accurate information when creating your account.
• You may not share your account or transfer it to another person.
• Notify us immediately at Tradenalyze@gmail.com if you suspect unauthorized access.

05. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Upload images that are not trading charts (e.g., images of other people, personal documents, or harmful content).
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or proprietary technology.
• Scrape, crawl, or systematically extract data from the Service.
• Use the Service to build a competing product.
• Circumvent, disable, or interfere with security-related features of the Service.
• Impersonate another person or entity.

06. Your content

You retain ownership of the chart images you upload and the analyses you save ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit Your Content solely to operate and provide the Service to you. This license ends when you delete Your Content or your account, except for residual copies briefly retained in backups.

You're responsible for Your Content, and you confirm you have the rights to upload it. Please only upload trading charts and avoid images containing other people or unrelated personal or sensitive information.

07. AI outputs

The Service uses AI to generate analyses, confidence scores, and explanations ("AI Outputs"). AI Outputs are produced by probabilistic models and may be incomplete, inaccurate, or out of date. They are not advice and should never be the sole basis for a trading decision. A confidence score reflects the AI's own self-assessed conviction and is not a validated or backtested statistic.

You're responsible for evaluating any AI Output before acting on it. We may update, retrain, or replace the underlying models at any time without notice.

08. Subscriptions and payments

• Tradenalyze offers a free tier and a paid Tradenalyze Pro subscription.
• All purchases are processed by Apple through the App Store. Payments, refunds, and billing disputes are governed by Apple's terms.
• Subscriptions auto-renew until cancelled. Manage or cancel your subscription in your iOS device's Subscription settings.
• We reserve the right to change pricing with reasonable notice.

09. Intellectual property

The Service, including its design, code, AI models, branding, and content (excluding Your Content), is owned by Tradenalyze and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements without prior written consent.

10. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

11. Third-party services

The Service integrates third-party services including Google (Gemini AI), Supabase, Apple, and RevenueCat. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service.

12. Risk disclosure

Trading financial instruments, including stocks, futures, forex, cryptocurrencies, and other assets, involves a substantial risk of loss and is not suitable for all investors. You may lose all or more than your initial investment. Past performance is not indicative of future results.

Tradenalyze does not provide investment advice. AI Outputs are educational and informational tools only. You are solely responsible for your own trading decisions. Never trade with money you cannot afford to lose. Consult a qualified financial adviser before making investment decisions.

13. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

14. Limitation of liability

To the maximum extent permitted by applicable law, Tradenalyze and its team members shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to trading losses, loss of profits, loss of data, or loss of goodwill, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or USD $100, whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless Tradenalyze and its team members from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

16. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

17. Termination

We may suspend or terminate your access to the Service at any time for any reason, including if we believe you have violated these Terms. You may terminate your account at any time via Settings → Delete Account. Sections that by their nature should survive termination (including Sections 9, 12, 13, 14, 15, 19, and 20) will survive.

18. Changes to these Terms

We may update these Terms from time to time. We'll notify you of material changes via in-app notification or email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

19. Governing law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction, as required by applicable consumer protection law in your jurisdiction.

20. Severability and entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms (together with the Privacy Policy) constitute the entire agreement between you and Tradenalyze regarding the Service and supersede all prior agreements.

21. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
